These Terms & Conditions govern the sale of goods via the Workplace Surplus website.

2. Scope of These Terms

These Terms apply to all purchases made through our website by consumers and business customers.
Where you are buying as a business, certain consumer protections may not apply.

By placing an order, you confirm that you have read and accepted these Terms.

3. Products & Descriptions

Workplace Surplus specialises in new surplus, ex-display, and refurbished office furniture and accessories.

• All products are sold “as described”
• Some items may be sold “as seen”
• Cosmetic condition, refurbishment status, or known marks will be clearly stated in the product listing where applicable
• Images are for illustrative purposes only and may not show minor cosmetic variation

We do not sell customer-returned goods.

4. Pricing & Payment

• All prices are shown in GBP (£)
• Prices include VAT where applicable (unless stated otherwise)
• Payment must be made in full at checkout before dispatch

We reserve the right to correct pricing or listing errors before dispatch. If this affects your order, you will be contacted and offered a refund or the option to proceed.

5. Order Acceptance & Contract Formation

A contract is formed only when your order is dispatched, not when payment is taken.

We reserve the right to:

• Decline or cancel an order due to stock availability
• Cancel orders affected by listing errors or pricing mistakes

If an order is cancelled, a full refund will be issued.

6. Delivery

Delivery details, dispatch times, and tracking information are set out in our Shipping & Returns Policy, which forms part of these Terms.

Risk in the goods passes to you upon delivery.

For pallet deliveries:

• Delivery is typically kerbside
• Access must be suitable for large vehicles
• Missed or failed deliveries may incur additional charges

7. Consumer Right to Cancel (Distance Selling)

If you are a consumer, you have the right to cancel your order within 14 days of receiving the goods, in accordance with the Consumer Contracts Regulations.

Conditions:

• Items must be unused and in resaleable condition
• You are responsible for return shipping costs
• No restocking fee applies

8. Faulty or Damaged Goods

If goods arrive damaged or faulty:

• You must notify us within 48 hours of delivery
• Clear photographs must be provided

Our remedy will be:

1. Replacement where stock is available
2. Refund only if replacement is not possible

Failure to report damage within 48 hours may limit our ability to assist.

9. Exclusions & Limitations of Liability

To the extent permitted by law:

• We are not liable for indirect or consequential losses
• We do not accept responsibility for loss of profit, business interruption, or installation costs
• Our liability is limited to the value of the goods supplied

Nothing in these Terms limits your statutory rights or our liability for death or personal injury caused by negligence.

10. Trade & Business Purchases

Where goods are purchased for business use:

• Consumer cancellation rights may not apply
• Goods are supplied strictly in accordance with the product description
• We do not provide extended warranties unless expressly stated

11. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including (but not limited to):

• Transport disruption
• Supplier failure
• Acts of God
• Industrial action

12. Privacy & Data Protection

Your personal data is handled in accordance with our Privacy Policy and applicable UK GDPR legislation.

13. Governing Law

These Terms are governed by the laws of England & Wales.
Any disputes will be subject to the exclusive jurisdiction of the English courts.
